PREAMBLE

This mobile application with the name of “Sri Sathya Sai Divyanga Jan Seva” (“App”) is owned and operated by Sri Sathya Sai Seva Organisations, India (“SSSSO”) and is primarily meant for registering physically challenged individuals with locomotor disability in India with a view to provide them with artificial assistive devices subject to terms and conditions as may be made applicable from time to time free of cost.

Sri Sathya Sai Seva Organisations, is a service organisation with a spiritual core and base to benefit all mankind without any discrimination based on caste, colour, creed or any other criteria whatsoever. Everything that we do is guided by these values, including the ways in which we collect, protect and use data.

The Sri Sathya Sai Divyanga Jan Seva (“initiative”) is an initiative of the SSSSO in India to provide artificial assistive devices to upto 100,000 (one lakh) 'Divyanga Jan' (physically challenged individuals) free of cost. As a part of effectively offering this service to the needy, SSSSO obtains some of the data of the potential beneficiaries who are required to register themselves through the App and are the user of this App.

Our Organisation is committed to ensuring the security and protection of the personal data provided by the users of this App and other related digital platforms, and to providing a compliant and consistent approach to data protection.

If you install, use or access this App or any of its features, it is understood that you have read and accepted the terms of this Privacy Policy and the Terms and Conditions mentioned herein. Please make sure to read them. 

By using this App, you are binding yourself, voluntarily to this Privacy Policy and the Terms and Conditions that are in force from time to time. If you don’t agree with and accept these, please do not use, install or access or register yourself on this App.

You also warrant and represent that any information that you submit during registering yourself or any other information that you submit or otherwise provide through this App is true, accurate and complete, and you agree to keep it that way at all times.

The below information is collected by this App:

• Date of birth
• Gender
• Blood Group
• Mobile number
• Address
• Educational Qualification
• Occupation
• Email address
• Personal picture
• Photo identification
• Annual Income
• Problem Statement
• Disability type and images
• Other information necessary for the purpose of the App

2) Information collected without a prompt:

• Device Information: We may collect the below with respect to any device through which this App is used or accessed:
  • Device Identifiers.
  • IP Address.
  • Operating System.
  • Device Make
  • User agents
• Information related to your use of the App such as content preferences and consumption, interaction with other users, user activity, etc.
• Usage and Log Information. We collect service-related, diagnostic, and performance information. This includes information about your activity (such as how you use the App, etc.), log files, and diagnostics, crash information, and performance logs and reports, etc.

Information We Do Not Collect

We do not collect any Sensitive Personal Data except as otherwise stated herein or information such as password related to other services, financial information such as bank account or credit card or debit card or other payment instrument details, physical, physiological and mental health condition, sexual orientation, medical records and history, or biometric information.

How We Use Information

• We use the information provided by you to:
  1. identify your specific need with respect to artificial assistive devices and determine your eligibility
  2. to help us operate, provide, improve, understand, customize the App.
  3. for displaying content based on your interest, location, etc. 
  4. Send you communications including by e-mail or text messages or any other medium including push notifications.
  5. try and ensure safety and security of our users and their information.
• We verify accounts and activity, and promote safety and security on and off the App, such as by investigating suspicious activity or violations of our policies, terms, etc., and to try and ensure that the App is being used legally.
• The information is used only towards the objective of the initiative of distribution of artificial assistive devices to the needy and eligible individuals who have registered through the App and strictly not for any commercial purpose.
• We may retain your information as long as we require this even after your request has been disposed off in accordance with the terms and conditions of mentioned herein and for such period as mandated by the concerned laws. 

Sharing of Information

We may share your information in ways including the following:

• We may share your information with the support personnel as may be assigned and other stakeholders of the SSSSO including its office bearers at various levels.
• We may share your information with institutions established by Bhagawan Sri Sathya Sai Baba and other affiliated organisations or allied Sai trusts and with our collaborators for curating and distributing the required limbs for the purpose of the initiative.
• We may share information about you, your device and usage information, to help us and others prevent fraud or any other illegitimate activity prohibited under any laws.
• We may share information about you for legal, safety, and security reasons.
• We may share information about you if we reasonably believe that disclosing the information is needed to: (i) comply with any valid legal process, governmental request, or applicable law, rule, or regulation, (ii) investigate, remedy, or enforce potential violations of this Policy, the Terms and Conditions and/or any other related policies.
• To protect the rights, property, or safety of ourselves, our users, or others.
• To detect and resolve any fraud or security concerns.

Mobile Device Access 

• The App may request access or permission to certain features from your mobile device, including your mobile device’s camera, microphone, sensors, SMS messages, storage and other features. If you wish to change our access or permissions, you may do so in your device’s settings.

Accessing Your Personal Information

Your personal information is accessible to you after you log in to your user account. However, we may withhold some information where the risk to you, your personal information, or our business is too great to disclose the information e.g. account password.

Deletion of your personal information

You may also request that we delete any personal information that we have collected from/about you by sending an email to sssdivyangajanseva@ssssoindia.org.

However, we may retain personal information as authorised under applicable law, such as personal information required as necessary to provide our services and for the purpose of our initiative and systems from fraudulent activity, comply with law enforcement requests pursuant to lawful process, for our own internal purposes reasonably related to your relationship with us, or to comply with any legal and statutory compliance obligations.

If you no longer wish to receive correspondence, emails, or other communications from us, you may opt-out by contacting us using the contact information provided below in this policy.

Security of Your Information

We use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse.  Any information disclosed online is vulnerable to interception and misuse by unauthorised parties.  Therefore, we cannot guarantee complete security for any personal information that you provide.

Law and Protection

We may collect, use, preserve, and share your information if we have a good-faith belief that it is reasonably necessary to: (a) respond pursuant to applicable law or regulations, to legal process, or to government requests; (b) enforce our Terms and any other applicable terms and policies, including for investigations of potential violations; (c) detect, investigate, prevent, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of our users or others or ourselves including the App.

Updates to Our Policy

We reserve the right to make changes to this Privacy Policy at any time and for any reason. If we make any changes to this policy, we will change the "Last Updated" date above. You agree that your continued use of the app and our services after such changes have been published will constitute your acceptance of such revised policy. If you do not agree with or accept this Policy, as amended, you must stop using the App. Please review our Privacy Policy from time to time.

Governing Law:

This Policy is governed by the laws of republic of India. 

 Conditions for Use

You’re not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. The app itself, and all the trademarks, copyright, database rights and other intellectual property rights related to it, still belong to and shall always continue to belong SSSSO.

We reserve the right to make changes to the app, at any time and for any reason. The App stores and processes personal data that you have provided to us, in order to provide our Service. It’s your responsibility to keep your phone and access to the app secure. You should be aware that we or the App will not take responsibility for data breach at user end. 

At some point, we may wish to update the app. We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, you must stop using the app, and (if needed) delete it from your device.

Registration

You must register using accurate data along with your mobile number. You also warrant that any registration information that you submit to App is true, accurate and complete, and you agree to keep it that way at all times.

Devices and Software

You must provide certain devices, software, and data connections to use our Services, which we otherwise do not supply. For as long as you use the App, you consent to downloading and installing related updates, including automatically.

Device Storage Permission

You provide us storage permission (read and write) by which we are able to upload your content to our server. You confirm you are authorised to provide us such permission in order to use the App.

User Information

We collect your personal information as mentioned in the privacy policy section herein above, for the purposes of the initiative and to help us identify you need and determine you eligibility to receive the artificial assistive devices under the initiative.

We do not share your data with any third party services or any other entity or institution except as otherwise mentioned in the Privacy Policy for the time being in force  unless it is required by law or other regulatory stipulations

Privacy policy and user data

We care about your privacy. The Privacy Policy  describes our information practices, including the types of information we receive and collect from you and how we use and share this information. You provide your unconditional acceptance to our Privacy Policy and agree to our data practices, including the collection, use, processing, and sharing of your information as described in our Privacy Policy.

Data Security

The security of your information collected and provided by you through the App is subject to the Privacy Policy. However, it is your responsibility to protect your usernames or user ID and passwords and the One time Passwords received through SMS to help prevent anyone from accessing or abusing your information or profile. You should not use or reuse the same passwords you use with other accounts as your password for accessing Sai Connect.

Children’s Usage

The App may be used by for the benefit of any child subject to their parents/guardian’s consent, who will subject themselves to these Terms and Conditions and Privacy Policy

Changes to these Terms and Conditions

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page. These changes are effective immediately after they are posted on this page.

In order to be eligible to receive free artificial assistive devices, you must besides other conditions as may be determined by us in our sole discretion from time to time, abide by and fulfil the following conditions:

• You need to register on the App and provide the requisite information
• You must provide accurate medical documentation as may be required to qualify for free assistive devices.
• Registration through the App is merely an application made by you to consider and determine your eligibility to receive the artificial assistive device under the initiative.
• The decision of SSSSO or any of its representative with regard to your eligibility or otherwise to receive the assistive artificial device is final and binding upon you without any questioning from you.
• You understand and agree that merely by registering on the App does not entitle you to the receive the assistive artificial device even if your disability is covered and entitled to be considered under the initiative and that you do not have any right or privilege to claim any benefit of any nature whatsoever in case your application is rejected or you are determined as not eligible.
• You must adhere to the prescribed guidelines for the safe and appropriate use of the assistive device.
• You are responsible for reporting any issues or malfunctions of the assistive device for prompt assistance.
• You must undergo periodic assessments to ensure the continued suitability and effectiveness of the assistive device.
• You must participate in training sessions to maximise the benefits of the assistive device.
• Any misuse or damage caused by negligence may result in the termination of the your eligibility for free assistive devices.
• You are required to return the assistive device upon completion of its useful life or upon request by the SSSSO.
• You must notify us of any changes in your medical condition that may affect the suitability of the assistive device.
• You undertake and agree that the assistive device remains the property of the SSSSO and should not be sold or transferred to others.
• The assistive devices covered under the initiative include all types of prosthetic and orthotic devices. However, mobility aids such as walkers, crutches, rollators, wheelchairs, and tricycles are not included.
